Acceptance
By downloading, installing or using Picnite you accept these terms. If you do not agree with them, do not use the application. The app is distributed through the Mac App Store, whose Apple terms of service also apply and prevail where relevant.
License and permitted use
Ovinion grants you a personal, non-exclusive, non-transferable and limited license to use Picnite on your own macOS devices for lawful purposes. You may create, edit, export and save your own images. You may not modify, decompile, extract the source code or redistribute the application, except as expressly permitted by applicable law.
User content
The images and projects you create or edit belong to you. You are solely responsible for the content you import, edit or share, and for ensuring you have the necessary rights to it.
Trial and purchase
Picnite includes a free 30-day trial with all features. After the trial, you can unlock the full version through a single payment in the App Store. It is not a subscription, it generates no renewals or automatic charges, and it can be restored at any time using the purchase restore feature.
Prices and payment terms are those shown by Apple in the App Store at the time of purchase. Apple processes the payment; Ovinion receives no payment data.
Availability
The application is provided "as is" and "as available". We work to make Picnite fast and reliable, but no software can guarantee permanent availability, the absence of errors, or full compatibility with every configuration or version of macOS.
Updates
Picnite may receive updates to fix bugs, improve performance or add features. These terms also apply to such updates, unless stated otherwise.
Limitation of liability
To the maximum extent permitted by law, Ovinion shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or revenue, arising from the use or inability to use Picnite, even if advised of the possibility of such damages. Ovinion's aggregate liability for any claim relating to Picnite is limited to the amount actually paid for the application.
We recommend keeping backups of your files. Before making important changes, save a copy of your images and projects elsewhere. Ovinion is not responsible for data loss due to incorrect use, a system interruption or the lack of backups.
Consumer rights
Nothing in these terms limits or excludes the rights granted to you by law as a consumer, or any liability that cannot be excluded by law, such as liability arising from intent or gross negligence. If any clause is invalid or unenforceable, the remaining clauses remain in full force, and the clause shall be interpreted as far as possible in a manner consistent with its purpose.
Intellectual property
Picnite, its code, design, brand, icons and documentation belong to Ovinion or its licensors. These terms do not transfer any ownership rights in them to you. The "Picnite" trademark and associated rights belong to Ovinion.
Privacy
Picnite works locally and collects no personal data. Read the details in our privacy policy.
Governing law and jurisdiction
These terms are governed by the laws of the Republic of Estonia, without prejudice to the mandatory rights granted to you as a consumer residing in the European Union. For claims arising from these terms, disputes shall be resolved before the competent courts of Estonia or, if you are a consumer, the courts of your place of residence.
Changes to these terms
We may update these terms. When we do, we will publish the new version on this page and update the review date. If you keep using Picnite after the change, you accept the new version. For any questions, contact us at ovinion.com/contact.
